Draft Minutes of meeting of Dunpender Community Council
held on Thursday
5th September at 7.30pm in The Stables

Present: Mrs J Priest, Mr E Martin, Mr D Wight, Ms A Pearson, Mrs E Gill, Mrs L Shaw-Stewart

In attendance: Ms A Hunter (minutes), Cllr L Jardine, Cllr N Hampshire, Verity Sinclair, Kate Courtney and Peter Beckman

1. Apologies: Mr H Thomas, Mrs A Cosgrove, Mr R Russel, Cllr D Collins

2. Minutes of meeting and AGM held on 6th June were agreed.

3. Police Report/CAPP

An incident at the beginning of July at Linn Rocks resulted in several people being charged. Since then Linn Rocks has been very quiet and enjoyed by locals and the odd visitor. Officers have continued to carry out patrols in the area.

The CO-OP was broken into during the early hours of the night at the beginning of August. Enquiries are still being carried out. Residents are reminded to remain vigilant and report any suspicious activity.
th October and a DCC representative, yet to be determined, will attend.

4. Matters Arising

4.1. AELCC

Mr Wight and Mr Thomas will jointly represent DCC on the AELCC community benefit committee. Mr Thomas will attend the next meeting on 12th September. Belltown Power have signed a Memorandum of Understanding between Newlands Hill Wind Energy Hub and Gifford Community Council and Garvald & Morham†Community Council regarding the use of community benefit. AELCC have discussed anti-social behaviour on buses with Paul McLennan, MSP.

4.2. Works for Balfour Beatty - Community Benefits Projects

Mrs Gill is waiting for an update from Peter Forsyth (ELC) and Glen Henderson (Balfour Beatty).

4.3. Linn Rocks policing/CCTV

Peter Beckman and Kate Courtney described the incident that took place on 4th July when their garden was invaded, attempts were made to pull up their trees and they were assaulted, having rocks thrown at themselves and their property. They followed procedures recommended to them by the police but there was no police response on the day after to calls to 101 and 999. A core group of individuals (some from East Linton) involved in repeated incidents were identified to police in April. Following the incident in July they have been spoken to and have not been back since. It was agreed the lack of an earlier police response was disappointing. CCTV has been installed.

4.4. Paths

Mill Lade - no update. Tyninghame to Binning Wood path is complete. A stonemason has been engaged to carry out work on the Pencraig path.

Lisa Douglas (Haddington) has quoted to update the East Linton Walks leaflet to include walks around Tyninghame. Mr Wight and Ms Pearson will obtain quotes for printing.

4.5. Vacancies

Mr Orr has resigned. Mr Thomas has joined. There are 3 outstanding vacancies nominally 2 from East Linton and 1 from Tyninghame/Whitekirk.

4.6 Meetings attended ñ vision for Belhaven Mrs Priest attended the meeting organised by Cllr Jardine where plans for a Community Asset Transfer for Belhaven Community Garden were revealed. Naomi Barnes from the community garden will be invited to provide further details. Cllr Hampshire advised that the land is owned by the NHS and designated for housing in the Local Development Plan.

Ms Pearson and Mr Wight attended ELCAN meetings looking at the priorities across East Lothian to improve biodiversity.
Mr Wight is meeting other community councillors to ensure the Local Place Plans are incorporated into the Local Area Plan for Dunbar and East Linton.

5. Area Partnerships

Mrs Cosgrove provided a report to say that the works at Preston Road will go ahead at the end September to widen the pavement at the church reducing the road to a single carriageway with a priority system and that School Road will be resurfaced. The next funding meeting is in October.

6. Finance

Mr Martin provided a budget forecast of known spending. It was agreed that any DCC contribution to the Xmas Lights insurance would be limited to £300. A decision will be made on this once other financial commitments and funding applications are known. An application will be made to DELAP in October to cover printing costs for the walk leaflet. This should leave sufficient funds to produce a new edition of Dunpender News.

7. Planning/Licensing Matters

Tyninghame Steading ñ DCC have responded ñ no further update.

Papple Provisional Premises licence ñ Mrs Gill presented DCC views at the EL licensing board ñ licence granted with conditions.
Newlandshill ñ Mrs Shaw Stewart responded on behalf of DCC. ELC planning committee unanimously agreed with the planning officers recommendation to refuse permission. This included members from all political parties include the Greens. The reasons for refusal included the location of site on the front face of the Lammermuirs having a negative impact on the landscape, detrimental ecological impact and the unsuitability of the planned construction route. It will now be decided by the Scottish Government Energy Consents Unit and if they disagree with ELC there will be a public enquiry.
East Links ñ An Appeal has been raised against refusal of planning permission. DCC have been invited to expand on their objection and Mrs Shaw-Stewart will respond on the basis that the proposed Dunbar to Haddington active travel corridor with a proposed speed limit of 40mph will further increase the chances of traffic from the east using the route through East Linton. Mr Wight highlighted that the Local Place Plan states residents have no wish for any development creating an increase in traffic.

8. Tyninghame/Whitekirk

The speed reactive signs in Tyninghame are now working.

9. Traprain/Markle/Whittingehame

Ms Pearson reported residents are happy the road at Traprain has been re-gravelled.

Mrs Gill reported she had written to ELC and Balfour Beatty about some concerns raised by residents at Markle about certain operational issues and to check that the significant loss of trees was in the original plan. Residents are also concerned about the timing for various works as following the road and bridge works ELC will address drainage and Scottish Water will re-route the current supply pipe. It was agreed to invite Peter Forsyth and Glen Henderson to the October meeting to provide an update and answer any queries from Markle residents that attend. So far during the course of the projects there have been no meetings or written communications to residents from ELC or Balfour Beatty.

10. Projects

10.1 Station Notice Board.
It was decided to drop this project due the number of existing boards at the station. Mrs Cosgrove will contact RAGES to query how defects to the lifts can be reported. Mr Wight highlighted the inconvenience of only one ticket machine in the car park.
10.2 Fountain This is now working following installation of a new tank and pump. Sean Govan has agreed to maintain the fountain. Mrs Gill will pursue a longer guarantee period for the work. Mrs Priest will inform Paul Iannetta that the work is complete.

10.3 Community Fair This was well attended by a number of groups who appreciated the networking opportunity. Public attendance was disappointing.

10.4 Facebook page Mrs Gill has created a new page - Dunpender CC.

Mrs Gill reported that there will be a formal consultation on plans at Crystal Rigg at a later date.

Mr Wight and Mrs Gill are looking at the ELC call for development sites as part of the Local Development Plan. Cllr Hampshire reported that the new Local Development Plan is underway with a requirement to find land in East Lothian for 1650 houses. The 10-year target is 6500 houses but 5000 are in current plans. He indicated that although developers hold options on land at the north of East Linton ELC would not support more houses due to the situation with the primary school. The new LDP will be in place in spring 2026. He explained that developer contributions are paid by housing unit so the developer pays the same for a 6 bed house as they do for a 1 bed incentivising larger houses being built.

The Bowling Club have been put in touch with a contact in Markle regarding installation of a defibrillator.
Mrs Priest highlighted Tesco in North Berwick are looking for organisations to participate in their blue token funding scheme.

Mrs Priest highlighted the current Police Scotland survey and will circulate the link.

Mrs Gill responded to SP Energy Networks Community Benefits Framework Consultation on behalf of DCC.

Mr Wight responded to an ELC consultation on climate change targets.

The issue of NWB lorries in the High Street was discussed. Cllr Hampshire confirmed it is not related to any ELC work. Mrs Gill confirmed lorries for Markle Bridge come from the west via Gilmerton.

12. Any Other Business

Mrs Gill will distribute the link for an ELC consultation on the website redesign.

Mrs Gill reported that there will be a formal consultation on plans at Crystal Rigg at a later date.
Mr Wight and Mrs Gill are looking at the ELC call for development sites as part of the Local Development Plan. Cllr Hampshire reported that the new Local Development Plan is underway with a requirement to find land in East Lothian for 1650 houses. The 10-year target is 6500 houses but 5000 are in current plans. He indicated that although developers hold options on land at the north of East Linton ELC would not support more houses due to the situation with the primary school. The new LDP will be in place in spring 2026. He explained that developer contributions are paid by housing unit so the developer pays the same for a 6 bed house as they do for a 1 bed incentivising larger houses being built.
The Bowling Club have been put in touch with a contact in Markle regarding installation of a defibrillator.
Mrs Priest highlighted Tesco in North Berwick are looking for organisations to participate in their blue token funding scheme.
Mrs Priest highlighted the current Police Scotland survey and will circulate the link.
Mrs Gill responded to SP Energy Networks Community Benefits Framework Consultation on behalf of DCC.
Mr Wight responded to an ELC consultation on climate change targets.
The issue of NWB lorries in the High Street was discussed. Cllr Hampshire confirmed it is not related to any ELC work. Mrs Gill confirmed lorries for Markle Bridge come from the west via Gilmerton.

1. Apologies: Mr H Thomas, Mrs A Cosgrove, Mr R Russel, Cllr D Collins

2. Minutes of meeting and AGM held on 6th June were agreed.

3. Police Report/CAPP

An incident at the beginning of July at Linn Rocks resulted in several people being charged. Since then Linn Rocks has been very quiet and enjoyed by locals and the odd visitor. Officers have continued to carry out patrols in the area.

The CO-OP was broken into during the early hours of the night at the beginning of August. Enquiries are still being carried out. Residents are reminded to remain vigilant and report any suspicious activity.
th October and a DCC representative, yet to be determined, will attend.

4. Matters Arising

4.1. AELCC

Mr Wight and Mr Thomas will jointly represent DCC on the AELCC community benefit committee. Mr Thomas will attend the next meeting on 12th September. Belltown Power have signed a Memorandum of Understanding between Newlands Hill Wind Energy Hub and Gifford Community Council and Garvald & Morham†Community Council regarding the use of community benefit. AELCC have discussed anti-social behaviour on buses with Paul McLennan, MSP.

4.2. Works for Balfour Beatty - Community Benefits Projects

Mrs Gill is waiting for an update from Peter Forsyth (ELC) and Glen Henderson (Balfour Beatty).

4.3. Linn Rocks policing/CCTV

Peter Beckman and Kate Courtney described the incident that took place on 4th July when their garden was invaded, attempts were made to pull up their trees and they were assaulted, having rocks thrown at themselves and their property. They followed procedures recommended to them by the police but there was no police response on the day after to calls to 101 and 999. A core group of individuals (some from East Linton) involved in repeated incidents were identified to police in April. Following the incident in July they have been spoken to and have not been back since. It was agreed the lack of an earlier police response was disappointing. CCTV has been installed.

4.4. Paths

Mill Lade - no update. Tyninghame to Binning Wood path is complete. A stonemason has been engaged to carry out work on the Pencraig path.

Lisa Douglas (Haddington) has quoted to update the East Linton Walks leaflet to include walks around Tyninghame. Mr Wight and Ms Pearson will obtain quotes for printing.

4.5. Vacancies

Mr Orr has resigned. Mr Thomas has joined. There are 3 outstanding vacancies nominally 2 from East Linton and 1 from Tyninghame/Whitekirk.

4.6 Meetings attended ñ vision for Belhaven Mrs Priest attended the meeting organised by Cllr Jardine where plans for a Community Asset Transfer for Belhaven Community Garden were revealed. Naomi Barnes from the community garden will be invited to provide further details. Cllr Hampshire advised that the land is owned by the NHS and designated for housing in the Local Development Plan.

Ms Pearson and Mr Wight attended ELCAN meetings looking at the priorities across East Lothian to improve biodiversity.
Mr Wight is meeting other community councillors to ensure the Local Place Plans are incorporated into the Local Area Plan for Dunbar and East Linton.

5. Area Partnerships

Mrs Cosgrove provided a report to say that the works at Preston Road will go ahead at the end September to widen the pavement at the church reducing the road to a single carriageway with a priority system and that School Road will be resurfaced. The next funding meeting is in October.

6. Finance

Mr Martin provided a budget forecast of known spending. It was agreed that any DCC contribution to the Xmas Lights insurance would be limited to £300. A decision will be made on this once other financial commitments and funding applications are known. An application will be made to DELAP in October to cover printing costs for the walk leaflet. This should leave sufficient funds to produce a new edition of Dunpender News.

7. Planning/Licensing Matters

Tyninghame Steading ñ DCC have responded ñ no further update.

Papple Provisional Premises licence ñ Mrs Gill presented DCC views at the EL licensing board ñ licence granted with conditions.
Newlandshill ñ Mrs Shaw Stewart responded on behalf of DCC. ELC planning committee unanimously agreed with the planning officers recommendation to refuse permission. This included members from all political parties include the Greens. The reasons for refusal included the location of site on the front face of the Lammermuirs having a negative impact on the landscape, detrimental ecological impact and the unsuitability of the planned construction route. It will now be decided by the Scottish Government Energy Consents Unit and if they disagree with ELC there will be a public enquiry.
East Links ñ An Appeal has been raised against refusal of planning permission. DCC have been invited to expand on their objection and Mrs Shaw-Stewart will respond on the basis that the proposed Dunbar to Haddington active travel corridor with a proposed speed limit of 40mph will further increase the chances of traffic from the east using the route through East Linton. Mr Wight highlighted that the Local Place Plan states residents have no wish for any development creating an increase in traffic.

8. Tyninghame/Whitekirk

The speed reactive signs in Tyninghame are now working.

9. Traprain/Markle/Whittingehame

Ms Pearson reported residents are happy the road at Traprain has been re-gravelled.

Mrs Gill reported she had written to ELC and Balfour Beatty about some concerns raised by residents at Markle about certain operational issues and to check that the significant loss of trees was in the original plan. Residents are also concerned about the timing for various works as following the road and bridge works ELC will address drainage and Scottish Water will re-route the current supply pipe. It was agreed to invite Peter Forsyth and Glen Henderson to the October meeting to provide an update and answer any queries from Markle residents that attend. So far during the course of the projects there have been no meetings or written communications to residents from ELC or Balfour Beatty.

10. Projects

10.1 Station Notice Board.
It was decided to drop this project due the number of existing boards at the station. Mrs Cosgrove will contact RAGES to query how defects to the lifts can be reported. Mr Wight highlighted the inconvenience of only one ticket machine in the car park.
10.2 Fountain This is now working following installation of a new tank and pump. Sean Govan has agreed to maintain the fountain. Mrs Gill will pursue a longer guarantee period for the work. Mrs Priest will inform Paul Iannetta that the work is complete.

10.3 Community Fair This was well attended by a number of groups who appreciated the networking opportunity. Public attendance was disappointing.

10.4 Facebook page Mrs Gill has created a new page - Dunpender CC.
